Terms and Conditions for Services

Introduction

Welcome to Jisort Ublow Enterprises ("Company," "we," "our," "us"). These Terms and Conditions ("Terms") govern your use of our website and services. By accessing or using our services, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use our services.

Definitions

  • Client: The individual or entity who purchases services from us.
  • Expert: The individual or entity providing services through our platform.
  • Services: All services provided by the experts through our platform.
  • Deliverables: The final output or work product provided by the expert to the client.
  • Project: The specific task or set of tasks assigned by the client to the expert.

Registration and Account Management

  • Client Registration: Clients must register on our platform by providing their name, email address, phone number, and password. The name is used for identification, the email address facilitates communication and must be unique, and the phone number serves as a crucial means of contact.
  • Onboarding: Upon registration, clients receive an onboarding email and are redirected to the login page. After logging in, clients can access their dashboard to manage their activities.
  • Expert Registration: Experts register by providing personal details, skills, payment information, identification documents, availability, and education. HR admins review expert profiles and activate accounts if they pass the interview process.
  • Account Termination: Clients and experts can terminate their accounts, which prevents further access to the platform. Termination notifications are sent via email.

Order Management

  • Creating an Order: Clients create orders by providing a title, a detailed description, selecting relevant categories, setting a due date, specifying a proposed budget, and uploading any accompanying documents.
  • Order Confirmation: A confirmation email is sent to the client, and the order details are displayed on the order page. Clients can cancel or update the order, make payments, or manage uploaded files.
  • Payment: Clients enter their phone number and the amount they wish to pay, ensuring it does not exceed the proposed budget. Payments are confirmed using the M-PESA PIN on their phone.

Payment Terms

  • Deposits:
    • Initial Deposit: A non-refundable deposit of 75% of the total project cost is required before any work on the project begins.
    • Final Payment: An additional 20% of the total project cost (bringing the total to 95%) must be paid before the client can view the final submission of the project deliverables.
  • Non-Refundable Policy: All payments made, including the initial deposit and any subsequent payments, are non-refundable except under the following conditions:
    • Failure to Deliver: If the expert fails to deliver the project according to the agreed timeline without a valid reason.
    • Mutual Agreement: If both the client and the expert agree to terminate the project and refund any payments made.

Project Assignment and Execution

  • Expert Application: Notifications are sent to all experts when an order is saved. Interested experts can apply to fulfill the order requirements.
  • Admin Review: Administrators review expert applications, confirm their ability to meet the order requirements and deadline, and request the client to make the required deposit.
  • Order Activation: When 75% of the total price is paid, the order is assigned to the expert and marked as active. The client is notified to prepare the remaining payment.
  • Project Completion: The expert uploads the solution, a video tutorial, a plagiarism report, and an AI report, then clicks the "Completed" button. In emergencies, experts must notify the administrator immediately to negotiate a deadline extension or reassign the order. Late submissions incur penalties.

Delivery and Revisions

  • Client Notification: After the expert submits the order, the client is notified via email that their solution is ready, with a link to view the submission and order details.
  • Client Actions: The client can mark the order as completed, request minor corrections, or reject the solution if dissatisfied. This process is iterative, with three or more accelerations leading to penalties for the expert. Valid rejections are reviewed by the administrator.

Legal Compliance

  • Compliance: By using our services, you agree that all submissions, content, and use of our platform comply with all applicable laws and do not infringe upon the rights of any third party. This includes but is not limited to copyright, trademark, and other intellectual property rights.
  • Prohibited Uses: You agree not to use our services for any unlawful purposes or to solicit the performance of any illegal activity or other activity which infringes the rights of others.

Confidentiality

  • Non-Disclosure: Both the client and the expert agree to keep all confidential information disclosed during the course of the project confidential and not to use it for any purpose other than the completion of the project.
  • Return of Materials: Upon request, each party will return all materials containing confidential information to the other party.

Termination

  • Termination by Client: The client may terminate the project at any time by providing written notice to the expert. However, all payments made up to the point of termination are non-refundable.
  • Termination by Expert: The expert may terminate the project if the client fails to make required payments, breaches any terms of the agreement, or engages in unlawful or unethical behavior.
  • Effect of Termination: Upon termination, the expert will cease work on the project, and the client will pay for all work completed up to the point of termination.

Dispute Resolution

  • Negotiation: In the event of a dispute, both parties agree to first attempt to resolve the issue through informal negotiation.
  • Mediation/Arbitration: If the dispute cannot be resolved through negotiation, it will be referred to mediation or arbitration, as agreed upon by both parties.

Limitation of Liability

  • Indirect Damages: Neither party will be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the services provided.
  • Total Liability: The total liability of either party for any claim arising out of or in connection with these Terms will not exceed the amount paid by the client for the services.

Governing Law

These Terms will be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law principles.

Amendments

We may amend these Terms from time to time by posting a revised version on our website. Your continued use of our services after any such amendments constitutes your acceptance of the new Terms.
